The IT sector is constantly changing and evolving. In consequence, the legal framework around it can seem blurry, especially when we know that it might be completely different from one country to another.
In Luxembourg, the Information Technology industry is very well developed. It is indeed the main pillar the country is investing on for the future. In order to support and help this sector grow, the government has been really involved in the past years and has created a set of specific IT laws.
Let’s have a look at 3 laws that are very helpful for your company in Luxembourg:
1. E-documents are the new norm.
As the first European country to acknowledge that electronic signatures have the same value as handwritten ones, Luxembourg has always emphasized the importance of e-documents and their uses in business. With the law of July, the 15th 2015, the Luxembourgish government gave electronic documents the legal recognition they deserve. Once certified by a PSDC (Prestataire de Services de Dématérialisation et de Conservation in French, which can be translated as a provider of dematerialisation and conservation services), an electronic copy of a document can now be used as a legal evidence.
2. No worries about the bankruptcy of your provider.
Luxembourg has also been the first European country to legislate about the fate of data stored by a Cloud company after bankruptcy. The amendment of the article 567 of the Commercial Code allows anyone (person or company) to claim their data from a bankrupted Cloud services supplier. This law offers you a trusted and secure environment to store your data in Luxembourg.
3. A safe for data.
Luxembourg wants to become an electronic fortress. In 2002, the government has created the CNPD, the National Data Protection Commission. This organization ensures that personal data are legally processed (by banks, companies,...) and that the privacy is respected. The CNPD has the power to investigate and impose sanctions. It can also require the data to be locked, deleted or even destroyed. Thanks to this Commission, data security in Luxembourg is strengthened and companies now have a way to defend themselves in case of a misuse of their data.
In a nutshell, in Luxembourg, your company will be more digital than ever with no need of worrying about your data.
